Sen. Ben Sasse, R-Neb., on Sunday said Democratic legislators would be “suicide bombing two branches of government” by expanding the number of justices on the Supreme Court.
In an interview on “Fox News Sunday,” Sasse also attacked Democratic presidential nominee Joe Biden for refusing to say if he would support the so-called “court packing.”
“It’s grotesque that Vice President Biden won’t answer that really basic question,” Sasse said.
“What [Democrats are] talking about is suicide bombing two branches of government,” he said, noting it would be accompanied by ending the Senate filibuster rule.
He called such a maneuver one that would “turn the Senate into just another House of Representatives…. to pack the Supreme Court.”
Sasse also argued that the fact Supreme Court justice nominee Amy Coney Barrett has been publicly opposed to abortion does not mean she can’t be fair on a case before the high court.
“She’s very clear about her jurisprudence,” Sasse said. “When she puts on her black robe… she knows what it is to be a judge, which is to cloak your political preferences.”
“If Amy Barrett were running for the United States Senate.… she’d have policy positions,” Sasse added.
“That isn’t what a judge’s job is,” he said.
“We have seen a politicization of the court … where the the left wants to turn it into a super legislature to advance things they can’t get done through the electorate,” he charged.
